HR & EMPLOYMENT
Individual employment relations
We support employers at every stage of the employment relationship. We advise them on the most suitable type of contract for their needs and draft employment contracts, paying particular attention to key clauses: job title and duties, remuneration, working time, mobility and non-compete.
We also assist businesses in designing and implementing their HR policies, particularly on pay, performance appraisal, mobility and working time.
In cases of employee misconduct, we advise on the appropriate disciplinary action and draft the related documents.
Finally, we advise on the termination of employment contracts: legal analysis, a full and detailed cost assessment, drafting of the documentation, negotiation and, where necessary, handling any resulting litigation.
MANAGING EMPLOYEE RELATIONS
Collective employment relations
We help businesses organise and manage their collective employment relations.
We negotiate, draft and revise company-level collective agreements, particularly on working time, pay and employee benefits. We put in place the documents that govern life within the company (internal rules, IT policy, remote working policy), as well as employee savings and profit-sharing schemes such as intéressement and participation.
We assist employers in setting up employee representative bodies and advise them on an ongoing basis on how these bodies operate. We also help them manage specific health and safety risks: preparing the mandatory occupational risk assessment (DUERP), preventing psychosocial risks, and handling workplace accidents and occupational illnesses.
Finally, we help manage collective disputes through mediation or negotiation and, where necessary, by representing the company in collective employment litigation: workplace elections, works council (CSE) consultations and challenges to union appointments.
MANAGING DISPUTES
Litigation · Negotiation · Mediation
We represent and defend our clients’ interests before all civil, administrative and criminal courts with jurisdiction over employment and social security matters, throughout France: the employment tribunal (conseil de prud’hommes), the civil court of first instance (tribunal judiciaire) and its social security division, the administrative court, the police court and the criminal court.
When a dispute arises, we favour a negotiated outcome, except where negotiation is ruled out as a matter of principle. Before any attempt at settlement, we work with the client to define what is at stake and the legal and financial framework within which the negotiation will take place. Our negotiation experience is one of the firm’s distinctive strengths.
Some situations lend themselves particularly well to mediation. Trained in mediation, we help you resolve suitable disputes amicably.
